Chapter 196

 

 

VENDORS, HAWKERS AND PEDDLERS

GENERAL REFERENCES

 

Vending and sidewalk, tag and auction sales -- See Ch. 198.

 

 

~ 196-1. License required.

 

  No person, with or without a team or vehicle, shall vend or hawk upon the public streets and sidewalks any goods, wares or other merchandise at public or private sale or auction or vend or peddle such articles from house to house within the town limits unless he shall have obtained a license to do so from the First Selectman or Town Clerk. This section, however, shall not apply to occupants of stores or shops or to authorized persons representing recognized charitable organizations or activities sponsored by the public schools within the town.

 

 

~ 196-2. Fee; duration of license; approval of weights and measures.

 

  The fee for such license shall be twenty-five dollars ($25.) for each year or portion thereof. All licenses shall be good for one (1) year after issuance, but no such license shall be issued by the First Selectman or the Town Clerk until the weights and measures of the applicant, if any such are used by him in his business, have been approved and stamped by the County Sealer of Weights and Measures and a certificate to that effect from the County Sealer of Weights and Measures has been exhibited to the First Selectman or the Town Clerk.

 

 

~ 196-3. Hours of operation; badge.

 

            A.        Such peddlers, either with or without a team or vehicle, shall be licensed to do business only between the hours of 7:00 a.m. and 5:00 p.m.

 

            B.         Each such peddler shall procure a badge with a number plainly engraved or fastened thereon from the First Selectman or the Town Clerk and shall wear such badge in a conspicuous place.

 

 

~ 196-4. Duty of licensing authorities.

 

            A.        Each of said licensing authorities are hereby required to issue a license mentioned aforesaid to whomsoever duly applies for the same and pays the license fee.

 

            B.         The licensing authorities shall pay over all money received for such licenses to the Town Treasurer as often as once a year and shall keep a record of all licenses so issued, together with the date thereof, the name of the licensee to whom given, the amount of money received therefor and what the license covers, which date, price and name of license and the thing licensed to be done shall also appear on the face of the license, and said licensing authorities shall not be entitled to receive from the town any extra compensation for services thus rendered.

 

 

~ 196-5. Exemptions.

 

  This chapter shall not apply to sales by farmers and gardeners of the produce of their farms and gardens or to the sale, distribution and delivery of milk, teas, coffees, spices, groceries, meat and baking goods, to sales on approval or to conditional sales of merchandise.

 

 

~ 196-6. Penalties for offenses.

 

  Any person who engages in a business of a peddler without complying with the provisions of this chapter relating to said business will be fined not more than fifty dollars ($50.).
